On October 19th the Department of Immigration & Citizenship wrote to NLC in response to the letter we wrote regarding the changes to the two year study rule for skilled migration applications. The government has recognised that there are many students who will be disadvantaged by the changes and has decided to change the requirement for the 2 year study rule to being 92 week courses as registered on Cricos. NLC understands that many students who contacted us may still not meet the requirements and is extremely disappointed that this is the case. NLC recommends that students who are in the situation where they have done a course over two years that are not eligible to meet skilled migration requirements to contact their education institution to see what they can offer to help them meet the requirements, ie some institutions are offering extra units to make up the time. In addition, it is recommended that students seek advice from a migration expert to see if they are able to apply for other visas.

As a result of further consultations within government and dialogue with representatives of the education industry, a decision has been taken to alter the benchmark used for immigration purposes and that the appropriate measure would be a course registered on CRICOS of 92 weeks in duration.
