As International Students are non-permanent residents of Australia, they are granted only limited rights outlined in the ESOS Act. Therefore enforcement of ESOS regulations and accessibility to legal help is essential to ensure NLCommunity is given a fair go under restricted circumstances.

NLCompliance handles compliance issues that mainly involve adherence to the Education Services for Overseas Students (ESOS) Act, and serious complications with visas requiring the intervention of NLC to the Department of Immigration and Citizenship (DIAC).

NLC National Office offers training in dealing with compliance issues for the Vice-President Compliance from the OSA STUDENTeam. NLC National Office is in constant contact with and offers regular advice to OSAs. OSAs ensure any failure to comply with ESOS requirements by the institution is referred to NLC National Office. NLC will report failures to comply with the ESOS Act to the Department of Employment, Education, and Workplace Relations (DEEWR) for enforcement.

In cases referred to NLC National Office where Overseas Student visas have been cancelled, NLC will investigate the matter and liaise with the individual, the education institution, and DIAC. NLC will follow due process and allow the individual to attempt to resolve the issue, while NLC monitors the situation. If the matter is unable to be resolved, or the resolution is deemed to be unfair and detrimental to the individual, NLC will provide third party intervention.

 

NLC expects 80 per cent of cases to be resolved on campus level by OSA STUDENTeam, with 20 per cent of cases referred to NLC National Office.

In matters requiring legal advice and representation, NLC has engaged the pro bono services of the law firm Gilbert and Tobin. This is a service provided free of charge to community groups such as NLC.
